Terms of Use

1. Who You Are Contracting With

These Terms of Service ("Terms") are a legal agreement between you ("User", "you") and Ailesco operated by Olesia Razmustova, registered in Georgia ("we", "us", "our"), operator of the MyPetNutrition mobile application ("App").

By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the App.

2. Description of the Service

MyPetNutrition is a personal dog nutrition and activity tracking application that allows you to:

• Log meals with calories, protein, fat, calcium, and phosphorus
• Track weight, body condition score (BCS), and daily calorie targets
• Record walks and view nutrition and activity analytics
• Read educational articles on dog nutrition (also available on our website)
• Export nutrition and weight data as a PDF for your veterinarian

The App provides informational tools only. It is not veterinary advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account.

If you use the App for a pet in your care, you confirm that you are the owner or authorised caretaker of that animal.

4. Account Registration

• You must provide accurate information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account.
• Notify us at legal@ailesco.com if you suspect unauthorised access.
• We may suspend or terminate accounts that violate these Terms.

5. Subscription and Payment

5.1 Free and paid tiers

The App may offer a free tier with limited features and a paid subscription with full access. Current pricing is displayed in the App and in the Apple App Store.

5.2 Billing

Subscriptions are billed through Apple In-App Purchase. Your payment is processed by Apple. We do not store your payment card details.

5.3 Renewals and cancellations

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Cancel via your Apple ID subscription settings.

5.4 Refunds

Refund requests are handled by Apple in accordance with their refund policy.

5.5 Price changes

We will give you at least 30 days' notice before increasing subscription prices.

6. Your Data and Content

6.1 Ownership

All data you enter (pet profiles, meals, weight records) belongs to you. We do not claim ownership over your content.

6.2 Licence to operate the service

By using the App, you grant us a limited, non-exclusive licence to store, process, and display your content solely to provide the service. This licence ends when you delete the content or close your account.

6.3 Your responsibility

You are responsible for the accuracy of the data you enter. You must not upload illegal content or content that infringes third-party rights.

7. Prohibited Uses

You must not use the App to:

• Violate any applicable law
• Upload malware or attempt unauthorised access to our systems
• Scrape, copy, or reverse-engineer the App
• Impersonate another person or organisation

8. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law.

In particular, we do not warrant uninterrupted availability, and the App is not a substitute for professional veterinary advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing limits liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded under applicable law.

10. Termination

You may delete your account at any time from the App settings. We will remove your data within 90 days as described in our Privacy Policy.

We may suspend or terminate your account immediately if you violate these Terms, or with 14 days' notice for any other reason.

11. Governing Law and Disputes

These Terms are governed by the laws of Georgia. Disputes shall be submitted to the exclusive jurisdiction of the courts of Georgia.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified at least 14 days before they take effect.

13. Apple App Store – Additional Terms

These Terms are between you and Ailesco only, not Apple Inc. Apple is not responsible for the App or its content.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
